Most Personal Care Products Are Genuinely Low-Hazard

This is the consistent finding across the personal care category: most cosmetics and personal care products classify as "not classified" for most GHS hazard categories. They are water-based or oil-based, non-flammable, non-corrosive, non-toxic, and not regulated for transport.

The classifications that typically apply are:

  • Eye irritation (Category 2) from surfactants in cleansers, shampoos, and washes.
  • Skin sensitisation from fragrance allergens (the 26 EU-regulated allergens) and preservative sensitisers.
  • Aquatic toxicity from preservatives, surfactants, or fragrance terpenes at concentration.

An SDS that shows "not classified" across most categories, with one or two mild classifications, is the honest, correct answer for a product that is genuinely mild. That document clears Amazon's DG flag by demonstrating there is nothing to hide.

Preservative Sensitisers: The Common Classification Thread

Across every water-based personal care product, the preservative system is often the component that triggers skin sensitisation classification. Common preservative sensitisers we identify by name:

  • Methylisothiazolinone (MIT) and methylchloroisothiazolinone (CMIT), potent sensitisers restricted in EU leave-on cosmetics. The most common preservative-driven sensitisation classification in personal care.
  • Formaldehyde-releasing preservatives, DMDM hydantoin, imidazolidinyl urea, diazolidinyl urea, quaternium-15. These release formaldehyde at low levels; the SDS must classify for formaldehyde sensitisation if above threshold.
  • Phenoxyethanol, widely used, generally low-hazard but can trigger eye irritation classification.
  • Parabens (methylparaben, propylparaben), EU-restricted at concentration, generally low GHS classification but subject to marketing-driven reformulation ("paraben-free").

The preservative choice is often the difference between a product that classifies with skin sensitisation and one that does not. The SDS identifies each preservative by name and classifies accordingly.

The Cosmetic vs. Drug Boundary: Claims Determine Your Category

The single most important regulatory concept for personal care sellers: your marketing claims determine whether your product is a cosmetic or an FDA OTC drug, and the two frameworks have completely different requirements.

  • Cosmetic claims ("cleanses," "moisturizes," "beautifies," "conditions") make your product a cosmetic under MoCRA.
  • Drug claims ("treats acne," "prevents cavities," "reduces dandruff," "reduces perspiration," "provides sun protection," "kills germs") make your product an FDA OTC drug with Drug Facts labelling, NDC number, and drug GMP requirements.

Products that cross the boundary in this catalog: sunscreen (always a drug), antiperspirant (drug), hand sanitizer (drug), anti-dandruff shampoo (drug), fluoride toothpaste (drug), antimicrobial mouthwash (drug), benzoyl peroxide acne treatment (drug), hydrocortisone cream (drug). Everything else in the personal care space is a cosmetic unless its claims say otherwise.

MoCRA (effective December 2023) changed the cosmetic side of this equation by introducing mandatory facility registration, product listing, adverse-event reporting, cosmetic GMP, and fragrance-allergen disclosure requirements. Most small cosmetic brands are still catching up.

The SDS is separate from both frameworks. It sits under OSHA HazCom, not FDA. But the SDS allergen and ingredient data feeds into MoCRA compliance, and understanding which framework your product falls under determines what other documentation you need beyond the SDS.

Transport Classification: Section 14

Most cosmetics and personal care products are not regulated for transport. The exceptions:

  • UN1950, aerosols, for aerosol hairspray, dry shampoo, spray deodorant, setting spray.
  • UN1266, perfumery products, for alcohol-based fine fragrances.
  • UN1170, ethanol solutions, for alcohol-based non-aerosol products (hand sanitizer, some toners).
  • UN1090, acetone, for nail polish remover.
  • UN1263, paint-related material, for nail polish.
  • Not regulated for transport, applies to most lotions, creams, serums, shampoos, conditioners, body washes, makeup, lip balm, and non-aerosol, non-alcohol personal care products.

Is my bath bomb or bath salt classified as hazmat?

Most bath bombs and bath salts are genuinely low-hazard. They may carry fragrance-allergen sensitisation and mild eye irritation from surfactants or citric acid, but are not flammable, not corrosive, and not regulated for transport. The SDS will reflect this honestly.

Is my anti-dandruff shampoo a drug?

Yes. Shampoos containing selenium sulfide, pyrithione zinc, or ketoconazole as anti-dandruff actives are FDA OTC drugs, not cosmetics. They need Drug Facts labelling and drug compliance. A regular (non-medicated) shampoo is a cosmetic under MoCRA. The SDS is separate from both.
